Terms of Service

1. Acceptance of terms

By accessing Aigentsphere (“the Service”) you accept these Terms of Service. If you do not accept, you must not use the Service.

We may update these terms from time to time. When we do, we will ask you to accept the new version on your next sign-in.

2. Eligibility

You must have authority to bind the organisation you sign up on behalf of. You must be at least the age of legal majority in your jurisdiction.

3. Acceptable use

You will not:

• Reverse-engineer, decompile, or attempt to derive source code from any part of the Service except to the extent permitted by mandatory law.
• Use the Service to violate any applicable law, regulation, or third-party right.
• Submit content that infringes intellectual-property rights or contains malware, illegal material, or material that is defamatory, obscene, or harassing.
• Use the Service to send unsolicited bulk communications.
• Attempt to interfere with the Service’s integrity, performance, or other customers’ use of it.
• Use the Service for any purpose related to autonomous targeting, lethal autonomous weapons, mass surveillance, or any application a reasonable person would consider hostile to democratic institutions or to human rights.

4. Customer data

Customer Data (as defined in your subscription agreement, including evaluation traces, prompts, model outputs, and metadata) belongs to your organisation. We process it to operate the Service.

We will not sell Customer Data and will not use it to train foundation models without your express written consent.

We host Customer Data in Australia and apply industry-standard security controls to protect it.

5. Privacy

Our Privacy Policy describes how we handle personal information. By using the Service you accept that policy.

6. Service-level commitments and credits

Service availability and credits are governed by the subscription agreement applicable to your plan. The current SLA is published in the customer portal.

7. Intellectual property

The Service, including all software, documentation, branding, and trade marks, is owned by Aigentsphere or its licensors. Subject to your continued compliance with these terms, Aigentsphere grants you a non-exclusive, non-transferable licence to use the Service for the duration of your subscription.

8. Termination

You may terminate your subscription at any time per the subscription agreement. We may suspend or terminate your access for material breach of these terms with reasonable notice (or immediately if continued access would harm the Service or other customers).

On termination we delete or return Customer Data per the Privacy Policy and the subscription agreement.

9. Liability

Except for liability that cannot be excluded under mandatory law, Aigentsphere’s aggregate liability under these terms is limited as set out in your subscription agreement. We are not liable for indirect, consequential, or punitive damages.

10. Governing law

These terms are governed by the laws of the State of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
